What if the judge awards you a certain amount of money during the divorce case, but before your spouse pays, he or she declares bankruptcy?
That may depend on whether the award is simply property or is considered as an award of spousal or child support. Debts owed because of a property award may be dischargeable; debts owed because of unpaid spousal or child support are not dischargeable. Characterizing the debt as one or the other, though, may be difficult.
