Division of property in a "separate property" (or "common law") state

In divorce proceedings, generally the judge may distribute both marital and non-marital property based on a number of factors, including the duration of the marriage, the age, health, occupation, income, and skills of each spouse, the amount of support awarded, and the contribution of each party to the acquisition of the property.
