Litigation is the process by which one party takes legal action against another whom he or she contends is liable for some type of damage. This process is time consuming and may last for a number of years before a resolution is obtained, either by way of judgment at trial or settlement among the parties. Some jurisdictions have undertaken measures to assist with earlier settlement by requiring the parties to participate in a settlement conference sometimes referred to as non-binding arbitration.
